Terms of Service

1. Acceptance
By using delegate.africa or the Delegate application (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.
2. What Delegate is — and is not
Delegate Network, Inc. operates a people-powered pilot marketplace that connects senders, reviewed travelers, and partner hubs to coordinate the movement of approved, documented items. Delegate is not a courier, freight forwarder, customs broker, carrier, or the seller of any goods. Delegate does not take title to goods, does not guarantee delivery, and is not the merchant of record for any retailer.
3. Eligibility
You must be at least 18 years old and able to form a binding contract.
4. Accounts and verification
You must provide accurate information and keep it current. Travelers and hub operators may be asked to complete manual review before performing certain pilot actions. We may approve, decline, suspend, or remove any account at our discretion, including for safety or policy reasons.
5. Roles and responsibilities
- Senders post requests and accurate item details and values, suggest a traveler reward, and confirm only lawful, permitted items.
- Travelers review each item before agreeing, may agree or decline, carry only approved and documented items, and never accept sealed or un-inspectable packages.
- Hubs act only as pickup/drop-off points: they record items in and out and hand over through the approved process. Hubs do not handle money, open packages, or resolve disputes.
6. Rewards, fees, and payment status
The sender suggests a traveler reward. During the pilot, Delegate Ops confirms totals manually before coordination. Service fees and hub handoff fees may apply when confirmed. Live payment rails and automated payouts are not yet represented as active unless Delegate confirms them in writing.
7. Prohibited and restricted items
You must comply with the Prohibited & Restricted Items Policy. You are solely responsible for ensuring items are lawful to send, carry, and receive on the relevant route.
8. Customs, duties, and taxes
You are responsible for providing accurate item descriptions and values and for any duties, taxes, or destination requirements that apply. Delegate is not responsible for customs determinations and does not act as importer of record or customs broker. Where a destination leg requires a licensed partner, Delegate will coordinate accordingly.
9. Retailers and affiliate links
Catalog products are sold by third-party retailers, not Delegate. Prices and availability come from the retailer and may change. Some links earn Delegate a commission at no extra cost to you (see Affiliate Disclosure).
10. Proof and chain of custody
You agree to participate in inspection, sealing, photo/scan documentation, and approved handoff records as part of using the Service.
11. No guarantee; “as is”
The Service is provided “as is” and “as available.” Delegate does not guarantee delivery times, item condition, retailer pricing, or uninterrupted service.
12. Limitation of liability
To the maximum extent permitted by law, Delegate and its officers, employees, and partners are not liable for indirect, incidental, special, or consequential damages, or for loss arising from the acts of senders, travelers, hubs, recipients, or retailers. Our total liability for any claim is limited to the service fees Delegate received for the transaction giving rise to the claim.
13. Indemnity
You agree to indemnify Delegate against claims arising from your breach of these Terms, your items, or your use of the Service.
14. Suspension and termination
We may suspend or terminate access at any time for violation of these Terms or for safety reasons.
15. Intellectual property
Delegate™ and Delegate Hub™ are trademarks of Delegate Network, Inc. Retailer names and logos belong to their owners and do not imply endorsement.
16. Governing law and disputes
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in King County, Washington (Seattle), and you consent to personal jurisdiction there. Where permitted by law, you and Delegate each waive any right to a jury trial and to participate in a class action. Nothing in this section limits rights you may have under the mandatory consumer protection laws of your country of residence.
17. Changes
We may update these Terms and will post the new date above.
